User Agreement & Privacy Consent

Casha Microfinance Bank Ltd ("Casha", "we", "our", or "us") is a financial institution licensed and regulated by the Central Bank of Nigeria (CBN). Casha provides digital financial services through our mobile app, website, and authorized partners.

By selecting "Create Account" or using our services, you confirm that you have read and agree to this User Agreement, Terms of Use, and Privacy Consent.

1. Eligibility and Account Registration

To use Casha services, you must be at least 18 years old and provide accurate information during registration. As required by regulation, we may collect and verify details such as your name, phone number, email address, residential address, date of birth, government-issued ID, BVN, NIN, photograph, and other identity verification information. Providing false information may result in account restriction or closure.

2. Data Collection and Processing

Casha collects and processes personal, financial, device, and transaction data to open and manage your account, process transactions, verify identity, prevent fraud, improve services, and comply with legal obligations. Where applicable, biometric verification such as facial recognition or fingerprint authentication may be used for security.

3. Data Sharing and Third Parties

Your information may be shared with trusted partners and regulators where necessary to operate our services, including payment processors, card networks, identity verification providers, credit bureaus, and regulatory authorities such as the Central Bank of Nigeria, in compliance with the Nigeria Data Protection Regulation (NDPR) and other applicable laws.

4. Account Security

Casha uses modern security measures including encryption, secure infrastructure, multi-factor authentication, and fraud monitoring systems. You are responsible for safeguarding your PIN, passwords, and one-time passwords (OTP). Do not share these credentials with anyone.

5. Services and Transactions

Through the Casha platform you may perform transfers, deposits, withdrawals, bill payments, card transactions, and merchant payments, subject to applicable fees, limits, network availability, and regulatory requirements. Casha may delay, decline, or reverse transactions where necessary for security, fraud prevention, or regulatory compliance.

6. Fraud Prevention and AML Compliance

To protect the financial system, Casha may monitor transactions, restrict accounts where fraud is suspected, and report suspicious activities in accordance with Anti-Money Laundering (AML) and Counter-Terrorism Financing regulations.

7. Communications and Notifications

By creating an account, you consent to receiving transaction alerts, security notifications, and service communications from Casha via SMS, email, phone calls, or in-app notifications.

8. Intellectual Property

All content, logos, trademarks, and materials on our platforms are owned by Casha or our licensors. You may not copy, modify, distribute, or use our intellectual property without prior written consent.

9. Prohibited Activities

You must not use our services for illegal activities, money laundering, fraud, or any purpose that violates applicable laws or these Terms. We may suspend or terminate accounts and report suspicious activity to relevant authorities.

10. Limitation of Liability

To the extent permitted by law, Casha shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our liability is limited to the amount of fees you have paid us in the twelve months preceding the claim, or as otherwise required by law.

11. Dispute Resolution

We encourage you to contact us first to resolve any disputes. Unresolved disputes may be referred to mediation or arbitration in accordance with Nigerian law. You may also lodge complaints with the Central Bank of Nigeria or other relevant regulators.

12. Updates to Terms

Casha may update this agreement from time to time. Continued use of the platform constitutes acceptance of any updates.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any legal proceedings shall be subject to the exclusive jurisdiction of Nigerian courts.
